Article 1 — Purpose

These JK Fandom Terms of Service (hereinafter, the "Terms") set forth the fundamental terms and conditions governing the use of the K-POP artist fandom service "JK Fandom" (hereinafter, the "Service") operated by Fan Communications Global Co., Ltd. (hereinafter, "FG"), between FG and its users.

Article 2 — Definitions

The following terms shall have the meanings set forth below when used in these Terms:

1. "User" means any person who agrees to these Terms, completes user registration as set forth in Article 4 (User Registration), and uses the Service.
2. "Content" means all information, photographs, images, videos, and other materials relating to artists, events, and any other subject matter provided by FG through the Service.
3. "User-Generated Content" means any text, images, or other information that a User posts, uploads, or transmits through the community functions or other features of the Service.
4. "Points (pt)" means the points required for use of each feature of the Service, the details of which are as set forth in Article 7 (Points).

Article 3 — Application of These Terms

1. These Terms apply to FG and all Users in connection with the use of the Service. By using the Service, Users agree to be bound by these Terms.
2. If a User downloads the Service from a third-party app store (Apple App Store, Google Play), the terms of service of the applicable store shall apply in addition to these Terms. In the event of any conflict, the terms of the applicable store shall prevail.

Article 4 — User Registration

1. Users shall complete user registration through the method designated by FG prior to using the Service.
2. Upon receipt of a user registration application, FG shall conduct a prescribed screening and complete user registration. FG may, at its discretion, reject a user registration application based on the results of such screening, and FG shall bear no obligation to disclose the reason for any such rejection to the applicant.
3. If any registered information changes, Users shall promptly complete the necessary update procedures through the method prescribed by FG. FG shall bear no liability for any disadvantage suffered by a User as a result of the User's failure to complete such update procedures.
4. Minors who use the Service must do so with the consent of their legal guardian (e.g., a parent or guardian with parental authority). Where a minor is using the Service, FG shall deem that such User has obtained consent from their legal guardian. Notwithstanding the foregoing, any person who does not meet the minimum age requirement set forth in Article 11 (Prohibited Conduct), Paragraph 1, Item (1) may not use the Service.

Article 5 — User's Responsibilities and Costs

1. Users shall, at their own cost and responsibility, prepare and maintain the communication devices, software, internet and telephone service contracts, and internet service provider subscriptions necessary to use the Service.
2. In addition to the costs set forth in the preceding paragraph, Users agree to bear all telephone and other communication costs, internet connection costs, electricity charges, and any other costs necessary to use the Service.
3. Users shall bear full responsibility for the use and management of the third-party service account credentials (IDs and passwords) required for login. FG shall bear no liability for any damage suffered by a User or any third party as a result of theft, unauthorized use, or other misuse of such IDs or passwords.

Article 6 — Service Features and Fees

1. By using the Service, Users may access features including voting for designated events and running support advertisements (hereinafter, the "Features"). The details of each Feature shall be separately set forth within the Service.
2. When purchasing paid services or Points, Users shall pay the fees separately designated by FG. Payment for such purchases shall be processed through the payment system of the applicable app store, and Users shall agree to that store's terms of service and complete any required registration.

Article 7 — Points

1. Users may access the Features by using Points in accordance with conditions separately designated by FG. The types of Points are as follows:
   1. Star Points (Star pt): Paid points that can be purchased by paying the fee separately designated by FG. Star Points do not expire.
   2. Oshi Points (Oshi pt): Free points awarded upon satisfaction of conditions separately designated by FG. Oshi Points expire 180 days from the date of acquisition.
   3. Heart Points (Heart pt): Free points awarded upon satisfaction of conditions separately designated by FG. Heart Points expire 180 days from the date of acquisition.
2. FG may, at any time, modify the conditions for Point use or temporarily suspend or discontinue Point purchases, use, or other Point-related functions.
3. Due to the nature of digital content, refunds are not available as a general rule. Notwithstanding the foregoing, refunds shall be processed in accordance with the applicable store's policy solely to the extent required by mandatory consumer protection laws of the User's country of residence.

Article 8 — Handling of User Information

1. FG shall handle the registered names and IDs of third-party services required for login, Service user IDs, passwords, other information required for use of the Service, and information relating to Users' actual usage of the Service, in accordance with the "Privacy Policy (JK Fandom)".
2. Upon a User's withdrawal from the Service, FG may delete the personal information of the withdrawn User after 90 days have elapsed from the date of withdrawal.

Article 9 — Advertisements

1. The Service may deliver video advertisements.
2. Video advertisements are delivered when a User taps the video advertisement play button. After viewing a video advertisement, the User may receive a designated number of free Points as determined by FG.
3. Users hereby agree in advance to the matters set forth in the preceding paragraphs.

Article 10 — Intellectual Property Rights

1. All intellectual property rights, including copyrights (including the rights set forth in Articles 27 and 28 of the Copyright Act of Japan; the same shall apply hereinafter), trademark rights, and design rights, as well as ownership and all other rights, in and to the Content on the Service and all other matters relating to the Service, shall vest in FG or the original rights holder.
2. The copyright in any User-Generated Content shall vest in the User who posted such content. Notwithstanding the foregoing, by posting User-Generated Content, each User hereby grants FG a worldwide, non-exclusive, royalty-free license to use (including to reproduce, adapt, and publicly transmit) such content for the purposes of operating, promoting, improving, or marketing the Service.

Article 11 — Prohibited Conduct

1. Users shall not engage in any of the following acts, or any act that may constitute any of the following, when using the Service:
   1. Use of the Service by any person under the age of 14 (or the minimum age for use prescribed by the laws and regulations of the User's country of residence).
   2. Reproducing, editing, or otherwise using any Content or data provided through the Service.
   3. Threatening, discriminatory, obscene, or defamatory statements or conduct.
   4. Any act that infringes upon the reputation, credit, or right of publicity of FG, any third party, or any relevant artist or group or their affiliated agency, whether within or outside of the Service.
   5. Unauthorized access to the Service or any attempt to do so.
   6. Use of automated tools, emulators, or other technical means to fraudulently manipulate voting results or rankings.
   7. Transferring, lending, selling, exchanging for fiat currency or other value (including Real Money Trading (RMT)), changing the holder of, or pledging as collateral, any Service account, login credentials, or Points, whether for consideration or free of charge.
   8. Using the Service by utilizing a third party's password or other credentials.
   9. Any act that infringes, or may infringe, upon the copyrights, intellectual property rights, or any other rights of FG or any third party.
   10. Any act that interferes, or may interfere, with the provision of the Service.
   11. Any act that violates applicable laws or regulations or public order and morals, or any other act that FG deems inappropriate in connection with use of the Service.
2. If FG separately communicates notices or requirements for compliance, Users shall not engage in any act prohibited by such notices or requirements, or any act that may constitute such a prohibited act.

Article 12 — Use of Community Features

1. The community features of the Service (including chat and image posting functions; hereinafter referred to in this Article as the "Community Features") are intended solely as a platform for Users to share information and impressions related to K-POP artists. The Community Features are not intended, and shall not be used, to facilitate romantic encounters, dating, or sexual contact, whether between persons of opposite or same sex.
2. In addition to the prohibitions in the preceding Article (Article 11), Users shall not engage in any of the following acts when using the Community Features:
   1. Posting messages or content for the purpose of seeking romantic encounters, dating, or sexual relationships with other Users, regardless of gender.
   2. Posting or sharing personal information of oneself or any third party (including full name, address, phone number, SNS account identifiers, or similar information).
   3. Posting images that are offensive to other Users, obscene, or that infringe upon the privacy of any third party.
   4. Sending messages or posting content that solicits or targets minors.
   5. Using the Community Features for commercial purposes (including advertising, solicitation, or sales).
   6. Any other act contrary to the purpose of the Community Features.
3. Users shall guarantee that their posted content does not infringe upon the copyrights, portrait rights, or any other rights of any third party. In the event of a dispute, the User shall resolve it at their own responsibility and expense.
4. FG reserves the right to monitor posts and messages made through the Community Features and, if FG determines that a User has violated these Terms, may, without prior notice, delete or restrict access to the relevant content, restrict the User's access to certain functions, or suspend the User's account.

Article 13 — Compliance with the Dating Site Regulation Act

1. The Service is operated on the basis that it does not constitute an "Internet Dating Service" (intaanetto isei shoukai jigyou) as defined under the Act on Regulation of Acts Inducing Children to Meet via Internet Dating Services (Act No. 83 of 2008; hereinafter, the "Dating Site Regulation Act").
2. Users are strictly prohibited from using the Community Features or any other function of the Service to post or transmit messages for the purpose of engaging in sexual intercourse, acts similar to sexual intercourse, obscene conduct, compensated dating, or any other sexual relationship with another person.
3. Users shall not view or transmit any content that may be used for the purposes described in the preceding paragraph. FG shall implement appropriate technical measures to prevent Users from accessing such content.
4. FG may provide information relating to any User suspected of violating this Article to law enforcement authorities or other relevant agencies, to the extent permitted by applicable law.

Article 14 — Response to Misuse

1. If FG reasonably determines that a User has violated, or is likely to violate, any item of Article 11 (Prohibited Conduct), Paragraph 1, FG may take any of the following measures against the User without prior notice, except to the extent restricted by mandatory laws of the User's country of residence:
   1. Invalidation of voting history or exclusion from rankings.
   2. Forfeiture of some or all Points held by the User (whether paid or free).
   3. Temporary suspension of access to the Service, or compulsory termination of account pursuant to Article 16 (Withdrawal), Paragraph 2.
2. Even if a User suffers damage as a result of the measures set forth in the preceding paragraph, FG shall bear no liability therefor. FG shall also bear no obligation to disclose the reason for any such measure.

Article 15 — Provision, Suspension, and Discontinuation of the Service

1. FG may, without prior notice to Users, modify, add to, or discontinue any portion of the Service, or temporarily suspend any portion of the Service, in any of the following circumstances:
   1. A specific artist disbands, retires, or any other circumstance arises that FG determines makes it difficult or inappropriate to continue offering benefits through the Service.
   2. Scheduled maintenance of the Service's infrastructure.
   3. Emergency or unplanned maintenance of the Service's infrastructure that is unavoidable.
   4. Unavailability of third-party services (including communication services) used by FG to provide the Service.
   5. Circumstances making provision of the Service difficult due to earthquakes, fires, natural disasters, power outages, or other unforeseen accidents.
   6. Circumstances making provision of the Service difficult due to war, conflict, civil unrest, riots, political upheaval, labor disputes, or other similar extraordinary events.
   7. Circumstances arising from the acts of a third party.
   8. FG's decision to discontinue a portion of the Service.
2. If FG intends to modify all of the Service's content or discontinue the Service entirely, or to temporarily suspend or discontinue the entire Service (except in cases of emergency infrastructure maintenance or force majeure), FG shall provide advance notice by posting on the Service or through another method FG deems appropriate.
3. If FG discontinues the entire Service pursuant to the preceding paragraph, FG may delete all Points held by Users as of the date of such discontinuation. In such case, except to the extent required by applicable law, FG shall bear no obligation to refund, exchange, or otherwise compensate Users for any deleted Points.

Article 16 — Withdrawal

1. Users may withdraw from the Service at any time by following the procedures separately designated by FG.
2. If FG determines that a User falls under Article 11 (Prohibited Conduct) or Article 19 (Exclusion of Antisocial Forces), FG may terminate such User's account.
3. Upon a User's withdrawal, all Points held by such User shall expire as of the date of withdrawal.

Article 17 — Amendment of These Terms

1. FG may amend these Terms by providing advance notice (in principle, at least 30 days in advance) through a method FG deems appropriate. Notwithstanding the foregoing, FG may amend these Terms at its discretion without obtaining individual consent from Users in either of the following cases:
   1. The amendment is in the general interest of Users.
   2. The amendment is not contrary to the purpose of the agreement, and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances related to the amendment.
2. If a User uses the Service after the effective date of the amended Terms, such User shall be deemed to have agreed to such amendment.

Article 18 — Confidentiality

Users shall treat as confidential any and all information that FG discloses to Users with an express indication that such information is confidential.

Article 19 — Exclusion of Antisocial Forces

1. Users represent and warrant to FG that, as of the present time and in the future, none of the following apply to the User:
   1. The User is not an antisocial force (meaning organized crime groups (boryokudan), organized crime group members, quasi-members of organized crime groups, organized crime group-affiliated companies, corporate racketeers (sokaiya), groups engaging in criminal activities under the guise of social movements, special intellectual crime groups, and any other groups or individuals equivalent to the foregoing; the same hereinafter) or a Sanctioned Party (meaning any individual or entity designated on sanctions lists maintained by the United Nations, the United States (OFAC), the European Union, Japan, or any other applicable authority), and has not ceased to be an antisocial force within the past five years.
   2. The User does not have a relationship in which antisocial forces are improperly utilized for the purpose of seeking improper gain for the User or a third party, or causing damage to a third party.
   3. The User has not, regardless of the name or form, provided funds or other benefits to antisocial forces, nor has the User engaged in transactions or interactions with any party knowing them to be an antisocial force.
   4. The User does not have any other socially condemnable relationship with antisocial forces.
   5. The User will not engage in any of the following: violent demands, demands exceeding legal liability, threatening statements or conduct, violence, spreading false rumors, fraudulent or coercive acts that damage the reputation of or interfere with the Service.
2. If any of the matters set forth in the preceding paragraph are found to apply to a User, such User shall immediately lose the right to use the Service.

Article 20 — Disclaimer

FG shall bear no liability whatsoever with respect to the following matters:

1. Any response, resolution, or indemnification in connection with disputes or conflicts arising between Users or between a User and a third party.
2. Any interruption or termination of the Service or any Feature without prior notice.

Article 21 — Damages

1. Except in cases of FG's willful misconduct or gross negligence, FG shall not be liable for any lost profits, indirect damages, special damages, consequential damages, attorney's fees, or other such costs incurred by Users. Notwithstanding the foregoing, if the mandatory laws of a User's country of residence provide otherwise, FG's liability shall be limited to the extent permitted by such laws.
2. Notwithstanding the preceding paragraph, even if FG is found liable for any reason, FG's aggregate liability to a User shall not exceed the total amount actually paid by such User to FG as consideration for the Service in connection with the event directly causing the damage.

Article 22 — Notices

1. Notices from FG to Users shall be deemed to have reached the User upon posting within the Service or upon transmission to the User's registered contact information.
2. FG shall bear no liability for any damage arising from a User's failure to view a notice or from a notice failing to reach the User due to the User's settings or other reasons.

Article 23 — Language, Governing Law, and Jurisdiction

1. The Japanese language version of these Terms shall be the authoritative text. In the event of any discrepancy between any translation and the Japanese version, the Japanese version (https://pages.jk-fandom.jp/terms/terms_ja.html) shall prevail.
2. These Terms shall be governed by and construed in accordance with the laws of Japan.
3. Any and all disputes between Users residing in Japan and FG arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court as the court of first instance, depending on the amount in dispute.
4. Any and all disputes between Users residing outside Japan and FG arising in connection with the Service shall be finally resolved by arbitration in Tokyo in accordance with the arbitration rules of the Japan Commercial Arbitration Association (JCAA). Arbitration proceedings shall be conducted in Japanese, and the arbitral award shall be final and binding on both parties.
5. All dispute resolution proceedings conducted pursuant to these Terms (including litigation and arbitration) shall be conducted on an individual basis, and shall not be conducted as any class action, class arbitration, or representative action. By agreeing to these Terms, Users expressly waive the right to participate as a plaintiff or class member in any class action.
6. The provisions of the preceding paragraphs shall not limit any mandatory legal rights to which Users are entitled under the consumer protection laws of their country of residence, including the right to bring a claim before local courts.

Article 24 — Entire Agreement and Severability

1. These Terms constitute the entire agreement between FG and Users with respect to the use of the Service, and supersede all prior oral or written agreements, representations, promises, and negotiations made prior to the execution of these Terms.
2. If any provision of these Terms is held to be invalid or unenforceable by a court or arbitral body of competent jurisdiction, the remaining provisions of these Terms shall continue in full force and effect.

Article 1 — Use of the Shop

1. In these SHOP Terms, "User" means any person who browses or uses the Shop upon agreeing to these SHOP Terms.
2. Users shall use the Shop in accordance with these SHOP Terms. FG deems any User to have agreed to these SHOP Terms upon using the Shop.
3. The Shop shall be used solely by the User in person; Users may not use the names or other information of third parties.
4. The Shop is available only to Users residing in countries and regions designated by FG as eligible sales territories. No sales contract shall be concluded with Users residing outside the eligible sales territories. The list of eligible sales territories is posted on the Shop and may be changed at FG's discretion.

Article 2 — Eligibility

1. Persons who do not meet the age requirement set forth in Article 11, Paragraph 1, Item (1) of the JK Fandom Terms — i.e. persons under 14 years of age, or below the minimum age required by the laws of their country of residence (whichever is higher) — may not use the Shop.
2. Minors (persons under 18 years of age in Japan; where the age of majority differs under local law, such law applies) who wish to purchase products must obtain prior consent from their legal representative (parent or guardian). Any sales contract concluded without such consent may be cancelled by the legal representative.
3. Persons whose legal capacity is restricted under applicable law — including adults subject to guardianship, curatorship, or other court-ordered legal capacity limitations (hereinafter "Persons with Restricted Legal Capacity") — must obtain the consent of, or act through, their authorised representative (guardian, curator, assistant, or equivalent) as required by law when purchasing products. Any contract concluded without the required consent may be cancelled by the Person with Restricted Legal Capacity or their legal representative.
4. Where a Person with Restricted Legal Capacity or a minor uses the Shop, FG deems that User to have obtained appropriate consent. To request cancellation of a contract, please contact FG at the designated contact set out in Article 19.

Article 3 — Disclosure of Business Information

1. FG shall clearly display the following information on the Shop:
   • Company name: FAN Communications Global, Inc.
   • Address: Aoyama Diamond Building, 1-1-8 Shibuya, Shibuya-ku, Tokyo 150-0002, Japan
   • Official website: https://jk-fandom.jp/en.html
   • Contact: fandom-info@fancsglobal.com (latest information posted on the Shop)
2. The selling price of products and the shipping fee shall be displayed on the payment screen prior to order confirmation. Customs duties, import consumption taxes, VAT, and other taxes and public charges related to importation vary depending on the destination country, product type, quantity, and other factors, and cannot be determined or displayed in advance by FG. All such costs shall be borne by the User (see Article 8).
3. The business information set forth in this Article is provided in compliance with the disclosure requirements of applicable e-commerce laws and regulations.

Article 4 — Delivery Information

1. Users shall enter their delivery information (name, address, phone number, email address, and any other information designated by FG) on the designated screen of the Shop when purchasing products.
2. FG sets out the handling of cases where shipment is not possible due to insufficient or incorrect information entered by the User in Article 13.

Article 5 — Purchase of Products

1. Users may purchase CD albums, merchandise, photo books, magazines, cosmetics, and other products designated by FG (hereinafter "Products") through the Shop.
2. When a User selects a product, enters the required information, and presses the purchase button, the User shall be deemed to have completed the purchase application process.
3. Where there are no grounds for declining under Article 6, FG shall place an order with its partner sales and fulfilment company in Korea (hereinafter "Partner Company").
4. A sales contract between FG and the User shall be concluded upon shipment of the Product.

Article 6 — Grounds for Declining Orders

1. FG may decline a purchase application where any of the following applies:
   1. FG reasonably determines the purchase is for resale purposes.
   2. The order quantity is so large as to be inconsistent with personal use.
   3. The User has previously refused to accept delivery.
   4. The purchase application contains false information.
   5. The User is found to have violated these SHOP Terms or the JK Fandom Terms.
   6. The User's application has previously been declined.
   7. The User's country of residence is not an eligible sales territory.
   8. Importation of the relevant Product is prohibited by the laws of the destination country.
   9. The order would violate applicable laws or regulations.
   10. FG otherwise determines the order to be inappropriate.
2. Notwithstanding the preceding paragraph, FG may also decline a purchase application where:
   1. There is an error in the product information (price or other terms of sale).
   2. The product cannot be shipped promptly due to out-of-stock status, discontinuation, or similar reasons.
   3. FG or the Partner Company determines the product to have defects or otherwise cannot be sold.
3. Except in cases of FG's wilful misconduct or gross negligence, FG shall bear no liability to the User in connection with a declination under this Article.

Article 7 — Payment

1. Users shall pay the product price and applicable taxes plus a shipping fee (hereinafter "Shipping Fee") corresponding to the destination country or region. The Shipping Fee varies depending on destination, product weight, size, and other factors, and will be displayed on the payment screen during checkout. Customs duties and import taxes are governed by Article 8.
2. Payment methods available in the Shop shall be as separately designated by FG. Available methods are displayed on the payment screen.
3. Users may use Points as separately designated by FG pursuant to the JK Fandom Terms (hereinafter "Points") for payment of purchases in the Shop. The conditions for earning, managing, and expiry of Points are governed by the JK Fandom Terms.
4. Where a cancellation or return arises in respect of a product purchased using Points, FG shall handle Points as follows:
   1. Where the cancellation or return is due to reasons attributable to FG (product defect, mis-delivery, order declined by FG, etc.): Points used shall be returned to the User.
   2. Where the cancellation or return is at the User's convenience: Points used shall not be returned.
5. Where a User pays by credit card, the User shall make payment in accordance with the terms separately agreed with their credit card company. Any dispute between the User and the credit card company shall be resolved between those parties.
6. Where a User selects bank transfer or convenience store payment, the application deadline displayed on the product page shall be the payment due date. If payment is not confirmed by the deadline, FG may decline the purchase application (see Article 6, Paragraph 1, Item (10)).

Article 8 — Personal Import (Customs Duties and Import Taxes)

1. Purchases through the Shop constitute personal imports in which the User purchases Products directly from the Partner Company in Korea. FG adopts a consignment-purchase model, placing orders with the Partner Company only after a User's order is confirmed.
2. All customs duties, import consumption taxes, VAT, excise taxes, and other costs arising from importation shall be borne solely by the User. FG bears no responsibility for such costs.
3. Payment of customs duties and similar charges shall be made directly between the User and the customs authority of the destination country.
4. If the User refuses to pay customs duties or similar charges and is consequently unable to receive the Product, FG shall not be obliged to accept a return or provide a refund.
5. Regarding the provisions of this Article, if the mandatory laws of the User's country of residence provide otherwise, FG and the User shall comply with such mandatory laws of the country of residence.

Article 9 — Prohibited Goods and Import Restrictions

1. Depending on the destination country, importation of some Products sold in the Shop may be restricted or prohibited. Users must check the import regulations and prohibited goods rules of their destination country in advance.
2. In the event of customs seizure, FG shall not be obliged to accept a return or provide a refund.
3. If shipment of specific Products is restricted or prohibited under Korean export control laws, FG shall notify the User and may decline the purchase application.

Article 10 — Delivery

1. After confirming payment and completing the order, FG shall ship the Product within the expected shipping period displayed on the product page. Where no expected shipping period is displayed, FG shall ship within 30 days of payment confirmation. Product pages for made-to-order items take precedence.
2. If FG is unable to ship within the relevant period, FG shall notify the User. The User may request cancellation after receiving such notice. However, if FG has already placed an order with the Partner Company, FG may decline the cancellation request.
3. Products purchased through the Shop may only be delivered to countries and regions designated by FG.
4. FG shall determine the shipping method taking into account the size, contents, destination country, and other factors of the purchased Product.
5. Due to the nature of international shipping, delivery may be delayed due to customs procedures and circumstances in the destination country.
6. The Shipping Fee varies by destination, product weight, size, and shipping method. The Shipping Fee for each order is displayed on the payment screen. FG endeavours to keep fee information current on the Shop; however, the amount displayed on the payment screen takes precedence.
7. For pre-order products, FG shall display the pre-order period and expected shipping date on the product page. If the expected shipping date changes, FG shall promptly notify the User.

Article 11 — Consumer Protection Policy

1. The Shop falls within the category of distance selling (online retail). Specific rules on returns and exchanges are set out in Article 12.
2. For Users in Japan, the statutory cooling-off right (unconditional right of withdrawal) under the Act on Specified Commercial Transactions (Japan) does not apply to distance selling.
3. For Users outside Japan, FG acknowledges that consumer protection laws vary by country and shall apply a consistent policy as set out in Article 12. Where the mandatory laws of a User's country of residence or destination country confer rights that are more protective than the provisions of Article 12, such laws shall take precedence.
4. To exercise rights under applicable mandatory laws, please contact FG at the designated contact set out in Article 19.

Article 12 — Returns and Exchanges

1. FG shall not, in principle, process returns or refunds at the User's convenience. However, where applicable mandatory laws of the User's country of residence or destination country confer a right of withdrawal or other return rights, such laws shall take precedence over this Article.
2. The same applies where a product page states "No returns as this is a pre-order item" or sets out other return conditions.
3. For returns at the User's convenience, the costs of return and outbound shipping and all other expenses shall be borne by the User. Customs duties and import taxes paid by the User shall not be refunded.
4. For returns due to reasons attributable to FG (defective products, mis-delivery, etc.), FG shall bear the reasonable costs of return. Customs duties and import taxes shall be handled as follows:
   1. [Exchange] FG shall reimburse the User for customs duties and import taxes incurred in connection with re-shipment of the replacement product.
   2. [Refund] FG shall refund the product price together with the amount equivalent to the customs duties and import taxes actually borne by the User. Where payment was made using Points, the Points used shall be returned.
5. The following rules apply to returns at the User's convenience by product category:
   1. [CD Albums]: Once the sealed audio/visual content has been opened, returns at the User's convenience are not accepted.
   2. [Photo Books and Magazines]: As publications, returns are not accepted in principle.
   3. [Cosmetics]: For hygiene reasons, returns are not accepted where the seal or outer packaging has been opened or damaged.
   4. [Merchandise and Other Items]: All other products sold in the Shop (keychains, apparel, photographs, and similar items not covered by (1)–(3) above) are not eligible for return at the User's convenience.
6. Notwithstanding the foregoing, Users may apply for a return or exchange by contacting FG at the designated contact within, in principle, 7 days of receipt — or within any longer period prescribed by applicable mandatory laws — where any of the following grounds exist:
   1. Wrong product received (a product different from the order was delivered).
   2. Damage or soiling during transit.
   3. Manufacturing defect or fault.
   4. Material discrepancy between the product page description and the actual product.
7. Users wishing to apply for a return or exchange must contact FG at the designated contact in advance. FG cannot accept returns shipped without prior contact.
8. FG shall in principle respond by way of exchange, and shall provide a refund only where the product is out of stock or exchange is not otherwise possible.
9. Regarding the provisions of this Article, if the mandatory laws of the User's country of residence provide otherwise, FG and the User shall comply with such mandatory laws of the country of residence.

Article 13 — Non-Delivery Due to Insufficient Delivery Information

1. Users bear responsibility for entering accurate delivery information.
2. Where a Product fails to reach the delivery address due to incorrect or insufficient information entered by the User or other reasons attributable to the User, FG shall bear no liability whatsoever for such non-delivery or any resulting loss or damage.
3. In such cases, FG shall not be obliged to refund the product price. However, where applicable mandatory laws require a refund or other remedy, such laws shall take precedence (see Article 11).

Article 14 — Prohibited Conduct

1. FG prohibits the following conduct when using the Shop. The prohibited conduct set out in Article 11 (Prohibited Conduct) of the JK Fandom Terms also applies.
   1. Purchasing for resale or other commercial purposes.
   2. Entering false information (including false declarations for customs purposes).
   3. Registering multiple accounts by the same individual or legal entity.
   4. Using another person's personal information or password.
   5. Unauthorised use of credit cards or other payment instruments.
   6. Any act intended to evade customs duties or import taxes.
   7. Applying to purchase or accepting delivery of prohibited or restricted import goods.
   8. Interfering with the operation of the Shop.
   9. Causing nuisance or damage to FG or any third party.
   10. Defaming or damaging the reputation of FG or any third party.
   11. Infringing the intellectual property rights of FG or the Shop.
   12. Violating these SHOP Terms, the JK Fandom Terms, applicable laws, or public order and morals.
   13. Any other conduct FG determines to be inappropriate.
2. Where a User engages in any conduct listed in the preceding paragraph, FG may suspend the Shop service or cancel the User's account registration without prior notice.

Article 15 — Personal Data Protection

1. FG shall provide the User's name, address, phone number, and other relevant information to the Partner Company for the purpose of shipping Products. Due to the nature of international shipping, such information may also be disclosed to customs authorities in the destination country for customs clearance purposes.
2. FG shall endeavour to comply with the personal data protection laws and regulations applicable in the User's country of residence and destination country.

Article 16 — Intellectual Property Rights

1. All intellectual property rights in the content and information of the Shop belong to FG or to third parties that have licensed their use to FG.
2. Users may not reproduce, distribute, sell, publish, or otherwise use intellectual property rights beyond personal use.

Article 17 — Suspension of the Shop

1. FG may suspend or discontinue the Shop without prior notice in the event of system maintenance, force majeure events (including natural disasters, epidemics, war, changes in laws, or changes in import/export restrictions), or other unavoidable circumstances.
2. Even if loss or damage arises from a temporary suspension, FG shall bear no liability except in cases of FG's wilful misconduct or negligence.

Article 18 — Disclaimer

1. FG shall be deemed to have fulfilled its notification obligations by sending notices in accordance with Article 21 (Notices).
2. FG or the Partner Company shall be deemed to have fulfilled its shipment obligation by dispatching the Product to the delivery address specified by the User. FG shall bear no liability even if delivery is not possible due to errors or deficiencies in the delivery information entered by the User.
3. Product images may differ slightly from the actual product in terms of colour or impression. FG shall bear no liability in this regard.
4. FG shall bear no liability for delays, loss, or damage in international shipping (including those caused by force majeure events) except in cases of FG's wilful misconduct or gross negligence.
5. Customs duties, import taxes, and similar charges are determined by the customs authorities of each country, and FG bears no responsibility for such amounts.
6. In respect of cosmetics, customs seizure may occur due to ingredient regulations in the destination country. FG endeavours to post ingredient information on the product page but does not warrant the completeness or currency of such information with respect to changes in ingredient regulations. FG shall bear no liability for seizure or loss arising from a User's failure to verify in advance (see Article 9).
7. The disclaimers in this Article shall not limit any rights to which Users are entitled under the mandatory laws of their country.

Article 19 — Complaints Handler

1. FG shall appoint a complaints handler to process complaints and enquiries from Users. The name and contact details of the complaints handler shall be posted separately on the Shop.
2. Upon receipt of a complaint, FG shall acknowledge receipt within 48 hours and shall take steps towards resolution within one month.
3. In addition to the procedures set out in this Article, Users may also lodge complaints with consumer protection authorities in their country of residence or destination country.

Article 20 — Damages

1. Except in cases of FG's wilful misconduct or gross negligence, FG shall not be liable for lost profits, indirect damages, special damages, legal fees, or similar losses. Where applicable mandatory laws provide otherwise, FG's liability shall be limited to the extent permitted by such laws.
2. Even where FG is liable for any reason, FG's liability shall be capped at the total amount actually received by FG as consideration in connection with the transaction that directly caused the loss suffered by the User.
3. Regarding the provisions of this Article, if the mandatory laws of the User's country of residence provide otherwise, FG and the User shall comply with such mandatory laws of the country of residence.

Article 21 — Notices

1. Notices from FG to Users shall be deemed to have reached the User upon posting on the Shop or upon transmission to the User's registered contact details.
2. FG shall bear no liability for any loss arising from the User's failure to check a notice or from a notice failing to reach the User due to the User's notification settings.

Article 22 — Amendments to the SHOP Terms

1. FG may amend these SHOP Terms by giving notice in principle at least 30 days in advance. Amendments consistent with the general interests of Users or otherwise reasonable may be made without individual consent.
2. FG deems a User to have consented to an amendment where the User uses the Shop on or after the effective date of the amended SHOP Terms.

Article 23 — Governing Language, Law, and Jurisdiction

1. These SHOP Terms shall be governed by the laws of Japan.
2. Any dispute between a User in Japan and FG shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court as the court of first instance.
3. Any dispute between a User outside Japan and FG shall be resolved by arbitration in Tokyo in accordance with the arbitration rules of the Japan Commercial Arbitration Association (JCAA). The arbitration proceedings shall be conducted in Japanese and the arbitral award shall be final and binding on both parties.
4. The foregoing provisions shall not limit any mandatory legal rights to which Users are entitled under the consumer protection laws of their country of residence.

Article 24 — Entire Agreement and Severability

1. These SHOP Terms constitute the entire agreement between FG and Users with respect to use of the Shop; provided, however, that the JK Fandom Terms shall continue to apply alongside these SHOP Terms.
2. Even if any provision of these SHOP Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
